Planning Commission Minutes
Meeting January 11, 2005
The January meeting of the Evendale Planning Commission ( EPC ) was called to order by acting Chairperson Jim Guthrie at 6 PM on January 11, 2005. The following Planning Commission members were in attendance:

Also in attendance were Brad Nixon and Ralph Terbrueggen from the Architectural Review Board, Tim Burke from Manley Burke law firm, James Jeffers, Village Engineer, Pam Morin, Village Building Dept. Clerk, Linda Fitzgerald, Evendale Consultant on Economic Development, Jack Cameron, Asst. to the Mayor, as well as the following residents/applicants/citizens:

INTERNAL BUSINESS
Prior to the Public Hearing it was decided that due to Kay Bostrom’s term expiring in December, the Planning Commission needed to elect a new Chairperson. Dick Shaffer nominated Jim Guthrie with Chris Schaefer seconding. The motion carried by a 4 to 0 vote with Jim Guthrie abstaining. Chairperson Guthrie then nominated Dick Shaffer to be Vice Chairman which was seconded by Michael Schwartzman. The vote to approve the nomination carried 4 to 0 with Member Shaffer abstaining.
PUBLIC HEARING for OKI AUTO AUCTION
Chairperson Guthrie asked for comments from the public and hearing none, Frank Raeon from Planning and Development Solutions presented OKI’s plan for use of the property and their request for a conditional use permit for outdoor storage and display. OKI has been operating at the current Reading Road location at 8200 Reading Road for three years for which their lease is now ending. OKI sells only new and used cars to dealers and not the public. The cars are consigned to OKI and are shown for sale each Wednesday at 11 AM to dealers. There is no repair to the cars, no cleanup, and all sales are “ as is “. Approximately 150-200 cars are offered for auction each week with 65%-80% actually sold. OKI offered the list of dealers consigning to OKI. OKI has an option on the property at 2521 Glendale-Milford Road
for a three year lease with options for up to two more years. OKI commented that the surrounding businesses were not affected because of proximity and that on site parking would be added on the South side of the property. OKI stated that there would be approximately 7 full time employees for this operation.
Jim Guthrie noted that the Zoning Code prohibits auto displays outdoors in the General Industrial District and the application does not meet provisional use criteria. The previous owner operated under a non-conforming use permit under 1264.04. The additional parking area must be paved and raised to avoid water problems. James Jeffers noted that if additions were made to the building it would have to be raised 7 ft. to meet the flood plain requirements. It was also noted that the Village would have no practical way to monitor if vehicles were stored on site for no more than 14 days. Zoning Code 1282.06 does not allow conditional use of outdoor vehicles for storage or sale. It was suggested that the Applicant should apply for a continuation of non conforming use under the provisions of the Code but that requires
substantiating verification that the property has not been in material use for a period of less than six months.
On a motion by Chris Schaefer to deny the request for conditional use permit with a second by Michael Schwartzman, the motion carried 5 to 0 and the request was denied.
INTERNAL BUSINESS
An Evendale Commons Business Park.
Anchor, represented by Matt Grever, Bob Trenkamp, and Mike Ricke, asked to bring the Planning Commission up to speed with several changes that would require appropriate approvals in the coming months and, in particular, from the Planning Commission at the Feb. 15 meeting.
Anchor has an option to acquire the property fronting Reading Road which previously had not been part of the original PBD. This property ( currently Stiney’s Motel ) would need to receive the zoning change to conform to the recently established HC zoning in Section C of the PBD and become parcel HC C-7 to make the seventh lot in the Section C.
Anchor also wants to split the HC Area A on the PBD into A1 and A2 which are roughly of equal size to be able to have more flexibility in attracting leasing businesses.
There was considerable discussion about the proposed changes and the overall Preliminary Plan submittal which is required under Section 1222.08. Items suggested by the Planning Commission for inclusion on the Preliminary Plan consisted of a) placing property lines for the OR lots as best guesses, b) show parks and bike/walking trails, c) detail of access to neighborhood retail ( C 1-7 ), d) show left turn lanes as called for in the traffic plan, e) try to show features planned and timing and f) try to make the Preliminary Plan as complete and detailed as possible given the constraints of the Projects early stage. All Members were asked to provide to Jack Cameron by the Friday following this meeting specific requested provisions to be incorporated in the Preliminary Plan to be shown on Feb. 15. The Commission is aware that
the developer is only required to meet the conditions for submittal provided in the Zoning Code.
B Planning Commission representation for the Regional Planning Commission ( RPC ) and CIC. The Chairperson asked for volunteers and Susan VanAmerongen will take the RPC and Michael Schwartzman will attend the CIC for the EPC.
C) The minutes from the October 19, 2004 meeting were approved as drafted. A motion to adjourn from Chris Schaefer with a second from Susan VanAmerongen was approved 5 to 0 and the meeting was adjourned at 9:05 PM.
